These Terms and Conditions were last updated on 17 July 2010.

All references to "the website", "us", "we", and "our" are to be construed as pertaining thereto. All references to "you", "the customer" or "the user" refer to the customer or consumer who uses the Aspiration Jewellery website and/or places an order for any item(s) from Aspiration Jewellery.

All orders must be paid for using Mastercard SecureCode, Verified by Visa or by personal cheque, and no contract will be formed in contravention of this unless Aspiration Jewellery decides in its sole discretion to complete the order. Aspiration Jewellery reserves the right to cancel any order, in whole or in part, at any time and refund the money paid in respect thereof.

1. Returns

Items purchased on the Aspiration Jewellery website can be returned for a full refund less any gift wrapping costs paid by the customer, provided always that:

(a) the item(s) are returned by the customer and at the customer's expense to Aspiration Jewellery, PO Box 10052, Glasgow G71 7WW;

(b) the item(s) are returned to Aspiration Jewellery in their original condition; and

(c) the item(s) are received by Aspiration Jewellery within 14 calendar days of the customer's receipt of the item(s). Item(s) delivered to the customer during the month of December can be returned to Aspiration Jewellery until the first Working Day in the fimmediately following January, where this would otherwise exceed the 14 calendar day period (e.g. items received by the customer on the 1st of December 2010 can be returned until the first Working Day in January 2011 and so on). This exceeds the statutory 7 day "cooling off" period granted to consumers through the Distance Selling Regulations but your statutory rights remain unaffected.

Whether items(s) are returned in "original condition" is to be decided solely by Aspiration Jewellery and this will include any jewellery box(es) and any white packer(s) of said jewellery box(es). 

   
If item(s) are returned in a condition with which Aspiration Jewellery is satisfied but without their jewellery box(es) or white packer(s) to the jewellery box(es), Aspiration Jewellery will refund the cost of the item(s) less any gift wrapping costs paid by the customer and less a £5.00 flat fee  per item to cover replacement of the jewellery box(es) and/or packer(s).  

If item(s) are returned without being adequately packaged in their original jewellery box(es) or in any other such way as to make them liable to being damaged in the post, AND Aspiration Jewellery deems that such damage has occurred, such item(s) will be deemed to have not been returned in their original condition and Aspiration Jewellery can refuse any refund. 

Receipt of the item(s) is deemed to be the date on which Royal Mail or other carrier used confirm in writing that they delivered the item to Aspiration Jewellery. The onus of proof is on the customer to prove that they posted the item(s) back to Aspiration Jewellery and that the item(s) were so delivered.

Notwithstanding the foregoing, personalised or altered items (including any  Special Order and/or any ring which has been resized with the customer's agreement) and pierced earrings and jewellery sets containing pierced earrings are non-returnable and no refund will be given in respect of the same.   

For the avoidance of doubt the conditions contained in this Clause 1 are a condition of any return and refund whether under the 7 day cooling off period under the Distance Selling Regulations or our own  extended 14 day return period.

2. Prices and availability of items 

Prices and availability of items are subject to change without prior notice. Recommended retail prices (RRPs) are to the best of our knowledge correct at the time when the item in question is added to the Aspiration Jewellery website or later updated by us (if applicable).

If you order an item which will not be available in a reasonable timeframe, either party can cancel the order (you can do this by emailing us; we can do it by cancelling the order from our system and letting you know).

3. Contract Formation

No contract will be formed between you and Aspiration Jewellery for the sale of any items until  payment is completed and the item ordered has been dispatched by Aspiration Jewellery.

Payment will be deemed complete on either (a) a confirmation email from Sagepay, Paypal or other payment processing provider to Aspiration Jewellery  (b) at such time as Aspiration Jewellery indicates via email that your cheque has been cleared by Aspiration Jewellery's bank or (c) in the event of a technical error, when Aspiration Jewellery confirms to you that your online or offline payment has been received and processed. Any email confirmation as detailed in this section, whether from Aspiration Jewellery or Sagepay or Paypal or other payment processing company, will be deemed complete and to have been effectively communicated to you at the time the confirmation email is sent, regardless of whether or not the email is received.

Any contract can be wholly or partially cancelled by Aspiration Jewellery at any time at its sole discretion and all moneys paid in respect thereof will be refunded subject to Clause 1 above. You are entitled under the Distance Selling Regulations to a 7 working day cooling off period within which time you are free to cancel the contract by notifying us in writing, although this does not apply to customised goods.

4. Liability

The use of this website is at your own risk. Aspiration Jewellery is not liable for any damage or loss whatsoever caused by the Internet or our website or any related information technology. Aspiration Jewellery does not warrant that the website will be uninterrupted or free from computer viruses or other malicious programs or any other technical difficulties which may cause direct, indirect, consequential, incidental or any other damage to you or any other party.

Aspiration Jewellery shall not be liable to you or any other party for any loss or damage suffered whatsoever, including direct or indirect loss of profit, except from death or personal injury resulting from our negligence, due directly or indirectly to any use of this website or reliance on it or its contents or any information, advice or otherwise in any way connected with it.

Nothing on this website is warranted, either expressly or impliedly, and nothing therein shall constitute advice and should not be relied upon in any decision-making. This website may include technical, typographical or other errors or omissions and Aspiration Jewellery will incur absolutely no liability arising from these. Aspiration Jewellery does not warrant the accuracy or reliability of any content, information, product or service provided by this website. All weights and sizes are approximate. References to "ctw" or "tcw" refer to the total carat weight of the diamonds (or other stones, as applicable) of the item in question, unless otherwise stated. Your statutory rights in relation to goods or services purchased through the website are not affected.

5. Links

No liability whatsoever will be incurred by Aspiration Jewellery in respect of any links contained in this website. Aspiration Jewellery does not monitor or endorse any material accessed by means of links from its website and takes no responsibility for the websites or material accessible via such links.

6. Variation

These Terms and Conditions may be changed by Aspiration Jewellery at any time at its sole discretion. Such changes will be intimated by the updated Terms and Conditions changes being posted on the website and you will therefore have been notified. The revised Terms and Conditions will take effect after a period of one week commencing from the time from which they are posted. By using the website thereafter, you will have accepted the varied terms and will be bound by them.

Aspiration Jewellery reserves the right to assign or otherwise transfer our right in and to the website and/or any realted contracts and/or information. The user may not assign, transfer or otherwise deal with the rights or obligations under these Terms & Conditions or the benefit or interest in any related contract.

7. Severability

In the event that any term of these Terms & Conditions is judicially held to be invalid or unenforceable, all of the remaining terms shall remain valid and enforceable.

8. Intellectual Property Rights

All copyright and related intellectual property rights in and relating to the website is owned by Aspiration Jewellery or our licensors unless otherwise agreed or specified. An individual page may be downloaded for private, non-commercial and personal use for the purpose of placing an order with Aspiration Jewellery or using this website as a shopping resource. With this exception, no contents of this website (including text, video, audio, audio-visual material, graphics, underlying source code and software) may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means without our prior written consent. Such permission can be requested by emailing Aspiration Jewellery at customerservice@aspirationjewellery.co.uk

All weights and measures are approximate. Images may be enhanced, enlarged or otherwise modified. Descriptions are complied by reference to information available to Aspiration Jewellery at the time of listing. Aspiration Jewellery shall incur no liability for inaccuracies in this respect but shall endeavour to refund or replace any item proven within 6 months of purchase by an independent registered gemmologist report to be incorrectly described to a significant extent. Aspiration Jewellery shall be the sole judge of "significant" in this respect.

9. Privacy

Aspiration Jewellery's privacy policy available at http://www.aspirationjewellery.co.uk/pages/Privacy-Notice-.html is deemed incorporated into these Terms and Conditions.

10. Governing Law

The use of this website and its Terms & Conditions and all contracts will be interpreted, construed and enforced in all respects in accordance with the laws of Scotland, and all parties irrevocably agree to the jurisdiction of the Scottish Courts.
